1. Introduction and acceptance of terms

The website www.kggoclub.com (the "Website") is operated by TukTuk One Co., Ltd. (บริษัท ตุ๊กตุ๊กวัน จำกัด), juristic person registration number / tax identification number 0105566154777, with its office at 20 Pradit Manutham Road, Plubpla, Wangthonglang, Bangkok 10310 ("the Company" or "we"), the distributor of products under the KG go and ShyOlive (Nitely) brands.

By accessing, browsing, registering as a member or ordering products through the Website, you are deemed to have read, understood and agreed to be bound by these Terms, including the Return Policy, Shipping Policy and Privacy Policy, which form part of these Terms. If you do not accept them, please stop using the Website.

2. User eligibility

  • You must be at least 20 years of age, or, if younger, must have the consent of your legal guardian.
  • You warrant that the information you provide when ordering and registering is true, accurate and up to date.
  • You are responsible for keeping your account password confidential and for activities that take place under your account, except where the damage is caused by the Company's fault or occurs after you have notified the Company of unauthorised use of the account.
  • The Company reserves the right to suspend or cancel accounts that are misused, that provide false information, or that breach these Terms.

3. Products, prices and payment

3.1 Product information

The Company makes every effort to display product details, ingredients, quantities and photos as accurately as possible. However, product colours shown on screen may differ slightly from the actual product depending on your device settings, and packaging may change between production batches.

3.2 Prices

  • All prices are shown in Thai baht (THB) and are inclusive of VAT, unless stated otherwise.
  • Prices do not include shipping fees, which are calculated and shown at checkout.
  • The Company reserves the right to change prices, adjust promotions or discontinue any product without prior notice. This does not affect orders that have already been confirmed.
  • If a price is displayed in obvious error (for example, an abnormal price resulting from a system error), the Company reserves the right to cancel the order and refund it in full, even if the order has already been confirmed.

3.3 Payment

  • Accepted methods: credit/debit card and PromptPay (PromptPay QR). The Company does not offer cash on delivery (COD).
  • Payments are processed through standard-compliant payment service providers. The Company does not store your credit or debit card details in the Company's systems.
  • An order is complete only when the Company has received payment in full and has sent you an order confirmation email.
  • The Company reserves the right to refuse or cancel any order if products are out of stock, fraud is suspected, or an unusually large quantity is ordered for resale.

3.4 Tax invoices

The Company is a VAT-registered business and issues tax invoices for every order as required by law. Customers who require a full tax invoice should provide their name, address and tax identification number during the ordering process. If you notify us more than 7 days after the order date, the Company may be unable to amend the buyer details on a tax invoice that has already been issued.

4. Promotions, discounts and coupons

  • Discount codes, coupons and free gifts are valid subject to the conditions, period and quantities stated in each campaign.
  • In general, they cannot be used in conjunction with other promotions unless clearly stated.
  • Discounts and coupons cannot be exchanged for cash, transferred, or given as change.
  • The Company reserves the right to revoke discount entitlements and cancel orders if it detects fraudulent use of codes, creation of duplicate accounts, or use that breaches the conditions.
  • In the event of a dispute, the Company will consider the matter in good faith and inform you of its reasons in writing. This does not deprive you of your right to dispute the decision, complain to the relevant authorities, or take legal action.

5. Disclaimer and health warnings (important)

The Company's products comprise foods and dietary supplements (with food registration numbers from the Thai Food and Drug Administration) and sleep products for external use, subject to the following warnings:

  1. Dietary supplements are not medicines and have no effect in preventing or treating disease. You should regularly eat a variety of foods from all 5 food groups in appropriate proportions.
  2. Results may vary from person to person, depending on physical condition, eating habits, exercise and other factors.
  3. Information, articles and reviews on the Website are intended for general knowledge only. They are not medical advice and do not replace a diagnosis by a doctor or pharmacist.
  4. Pregnant women, breastfeeding women, children, people with underlying medical conditions, people taking regular medication, and people preparing for surgery should consult a doctor before consumption.
  5. Always read the label, ingredients, warnings and allergen information on the packaging before each use. If an allergic reaction occurs, stop use and consult a doctor immediately.
  6. Do not consume more than the amount recommended on the label.
  7. Sleep accessory products such as Mouth Tape are not suitable for people who have difficulty breathing through the nose, people with sleep apnoea, people who have consumed alcohol or are taking medication that causes drowsiness, children, and people who cannot remove the tape by themselves. Please read the warnings on the packaging and consult a doctor if you are unsure.
  8. Pillow Spray is a product for external use on bedding only. Do not ingest. Do not spray into the eyes or directly onto the skin. Keep out of reach of children.

Sleep products for external use (Pillow Spray, Mouth Tape, Steam Eye Mask) are not classified as food and therefore do not have food registration numbers. Please read the directions and warnings on the packaging before each use.

6. Intellectual property

  • All content on the Website, including the trademarks KG go, ShyOlive and Nitely, the characters ShyShy and ShyGuy, logos, photographs, illustrations, videos, text, product formulas, packaging designs and software, is the property of the Company or its licensors and is protected under copyright and trademark law.
  • Reproduction, modification, publication, sale or commercial use, in whole or in part, without written permission from the Company is prohibited.
  • Use of the brand names or product images for personal reviews made in good faith, which do not give the misleading impression of an association with the Company, is permitted.

7. User-generated content (reviews, photos, videos)

  • When you send reviews, comments, photos or videos to the Company directly, or publish them with the Company's campaign hashtag, you are deemed to permit the Company to use, reproduce, adapt and publish that content for marketing and public relations purposes without compensation. This permission is non-exclusive and may be revoked by you.
  • You warrant that the content is your own, does not infringe the rights of any other person, and reflects opinions based on your real experience. If the content includes images of other people, you warrant that you have obtained their consent.
  • If you would like the Company to stop using your content, please notify us at team@tuktukone.com. The Company will stop using it in new media within 14 days. However, media already printed or advertising space booked in advance may take longer to withdraw.
  • The Company reserves the right to remove content that is unlawful, offensive, false, disguised advertising, or that makes exaggerated medical claims.

8. Distributors and resale

  • Products sold on this Website are for personal consumption only.
  • Commercial resale of products, whether through online stores, marketplace platforms or export to other countries, is prohibited without written appointment by the Company.
  • The Company reserves the right to limit purchase quantities per order or per account, and to refuse orders that appear to be for resale.

9. Limitation of liability

  • The Company provides the Website "as is" and does not warrant that the Website will be free from errors, interruptions or viruses.
  • To the maximum extent permitted by law, the Company is not liable for indirect damages, consequential damages, loss of business opportunity or loss of data arising from use of the Website.
  • The Company's total liability for any order shall not exceed the amount you actually paid for that order.
  • The above limitations do not apply to liability arising from the Company's wilful misconduct or gross negligence, death or bodily injury, or liability that cannot be excluded under Thai law, including the Liability for Damages Arising from Unsafe Products Act B.E. 2551 (2008).

10. Force majeure

The Company shall not be liable for any delay or inability to perform its obligations due to causes reasonably beyond its control, such as natural disasters, floods, epidemics, government announcements, disruption of logistics or payment systems, or riots.

11. Links to external websites

The Website may contain links to third-party websites. The Company has no control over and is not responsible for the content, policies or practices of those websites.

12. Amendments to these Terms

The Company may amend these Terms at any time by publishing the revised version on the Website with the date of update. Continued use of the Website after publication constitutes acceptance of the new Terms. However, the Terms that apply to your order are the version in effect on the date you placed the order.

13. Governing law and dispute resolution

  • These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand.
  • In the event of a dispute, the parties agree first to negotiate in good faith.
  • If no agreement can be reached, the dispute shall be submitted to a court of competent jurisdiction in the Kingdom of Thailand. This does not deprive consumers of the right to bring proceedings in a court of competent jurisdiction under the law on consumer case procedure.
  • You may file a complaint with the Office of the Consumer Protection Board (OCPB) via hotline 1166.
  • These Terms are issued in both Thai and English. In the event of any conflict between the two, the Thai version shall prevail.
